BetterBets LLC, a Wyoming limited liability company ("BetterBets," "we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit https://shopbetterbets.com (the "Site"), join our Discord community, subscribe to our emails, purchase a membership, or otherwise use our services (collectively, the "Services").

By using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services. This Policy is incorporated into our Terms of Service.

1. Who We Are and Scope

This Policy applies to personal information we process as a business when you interact with the Services. It does not apply to third-party websites, platforms, or services we do not control, including sportsbooks, Discord, and our payment processor, each of which has its own privacy practices. See Section 9.

2. Information We Collect

We collect the following categories of information:

2.1 Information you provide directly.

• Identifiers and contact data: your first name and email address, which you provide through our sign-up forms (for example, to receive a free daily pick or a Discord invite), and any name or username you use in our community.
• Account and membership data: information associated with your membership, preferences, and the tier you select.
• Payment data: when you purchase a Paid Membership, you provide payment information to our third-party payment processor. We do not collect or store your full payment card number. We may receive limited billing details such as the last four digits of your card, card type, billing ZIP or country, transaction amount, and subscription status.
• Communications: information you provide when you contact us, post in our Discord, respond to emails, submit testimonials or results, or participate in surveys or promotions.

2.2 Information collected automatically. When you use the Site, we and our service providers may automatically collect:

• Device and technical data: IP address, browser type, operating system, device identifiers, language, and referring or exit pages.
• Usage data: pages viewed, links clicked, time on site, and interactions with emails (such as opens and clicks).
• Cookies and similar technologies: as described in Section 4.

2.3 Information from third parties. We may receive information from:

• our payment processor (transaction and subscription status);
• Discord (your username and membership in our server, subject to Discord's terms);
• our email platform and analytics or advertising providers (engagement and audience data);
• referrals, affiliates, or publicly available sources.

We do not intentionally collect special categories of sensitive personal information, and we ask that you not send us such information.

3. How We Use Information

We use personal information to:

• provide, operate, and maintain the Services, including delivering picks, content, and Discord access;
• send the free daily pick and other content you request;
• process payments, manage subscriptions, and handle auto-renewals, billing, and cancellations;
• send transactional and service messages (for example, receipts, renewal notices, account and security alerts, and changes to our policies);
• send marketing and promotional emails through our email platform, where permitted, and measure their effectiveness;
• respond to your inquiries and provide support;
• personalize and improve the Services and develop new features;
• conduct analytics and understand how the Services are used;
• verify eligibility, including age and jurisdiction self-certification, and enforce our Terms;
• detect, prevent, and address fraud, abuse, security incidents, and chargebacks;
• comply with legal obligations and enforce our agreements; and
• with your consent, for any other purpose disclosed at the time of collection.

Legal bases (where applicable). Where data-protection laws such as the GDPR apply, we process personal information based on: performance of a contract (to provide the Services you request); our legitimate interests (to operate, secure, and improve the Services and market to existing customers); your consent (for certain marketing and cookies); and compliance with legal obligations.

4. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, tags, and similar technologies to operate the Site, remember your preferences, measure performance, analyze traffic, and support marketing. These include:

• Strictly necessary technologies required for the Site to function;
• Analytics technologies that help us understand usage; and
• Advertising and marketing technologies, including email tracking pixels and, if used, advertising platform pixels that may help us reach you or similar audiences.

You can control cookies through your browser settings and, where available, through any cookie banner or preference tool we provide. Disabling some cookies may affect how the Site works. For how we respond to "Do Not Track," see Section 13.

5. How We Share and Disclose Information

We do not sell your personal information for money. We may share personal information as follows:

5.1 Service providers (processors). We share information with vendors that perform services for us, under contracts that limit their use of the information, including:

• our email and marketing platform (Kit, also known as ConvertKit) to manage email lists and send communications;
• our payment processor to process payments and manage subscriptions;
• hosting, infrastructure, and security providers;
• analytics providers; and
• Discord, which hosts our community.

5.2 Legal and safety. We may disclose information if we believe it is necessary to comply with a law, regulation, legal process, or governmental request; to enforce our Terms; to detect or prevent fraud, security, or technical issues; or to protect the rights, property, or safety of BetterBets, our users, or others.

5.3 Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.

5.4 With your direction or consent. We may share information when you ask us to or otherwise consent.

5.5 Aggregated or de-identified data. We may share information that has been aggregated or de-identified so that it does not reasonably identify you.

Note on "sharing" for targeted advertising. Some state laws define "sale" or "sharing" broadly to include certain uses of cookies for cross-context behavioral advertising. To the extent we engage in any such activity, you may opt out as described in Section 11.

6. Email Marketing and Your Choices

When you submit your email, you may receive our free picks and marketing emails. Every marketing email includes an unsubscribe link, and you can opt out at any time. We honor opt-outs promptly as required by the CAN-SPAM Act and similar laws. Even after you opt out of marketing, we may still send transactional or service messages related to your account, purchases, or these policies. Marketing emails are sent through our email platform (Kit / ConvertKit), which processes your email and engagement data on our behalf.

7. Data Retention

We retain personal information for as long as needed to provide the Services, maintain your account, comply with our legal and tax obligations, resolve disputes, prevent fraud, and enforce our agreements. When information is no longer needed, we delete, anonymize, or securely store it. Retention periods vary based on the type of information and the purpose for which it was collected.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials and Discord access confidential. If we become aware of a security incident affecting your personal information, we will notify you as required by applicable law.

9. Third-Party Services and Links

The Services link to or operate with third parties, including sportsbooks, Discord, our payment processor, and our email platform. We are not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies. Any information you provide directly to a third party is governed by that party's policy, not ours.

10. Children's Privacy

The Services are intended only for adults who are at least 21 years old (or the legal age for sports wagering in their jurisdiction). The Services are not directed to children, and we do not knowingly collect personal information from anyone under 18, and specifically not from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a child in violation of law, we will delete it. If you believe a child has provided us information, contact us using the details in Section 15.

11. Your Privacy Rights

Depending on where you live, you may have some or all of the rights described below. We will not discriminate against you for exercising these rights.

11.1 Rights that may be available to you:

• Access / know: request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients.
• Correction: request that we correct inaccurate personal information.
• Deletion: request that we delete personal information we hold about you, subject to legal exceptions.
• Portability: request a copy of certain information in a portable format.
• Opt out of targeted advertising, "sale," or "sharing": to the extent applicable.
• Opt out of marketing: unsubscribe from marketing emails at any time.
• Withdraw consent: where processing is based on consent.

11.2 California residents (CCPA/CPRA). If you are a California resident, you have the rights to know, access, correct, and delete your personal information, to opt out of the "sale" or "sharing" of personal information, and to limit the use of sensitive personal information, as those terms are defined under California law. We do not sell personal information for money. In the prior 12 months, we may have collected the categories of information described in Section 2 (identifiers, customer records, internet/network activity, and commercial information) and disclosed them to the service providers described in Section 5 for the business purposes described in Section 3. California's "Shine the Light" law also allows California residents to request information about disclosures to third parties for their direct marketing purposes; we do not share personal information with third parties for their own direct marketing.

11.3 Other U.S. state residents. Residents of states with comprehensive privacy laws (including, for example, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and others) may have similar rights to access, correct, delete, obtain a copy of, and opt out of targeted advertising or profiling. Some states allow you to appeal a denial of your request; if we deny your request, we will explain how to appeal.

11.4 EU/UK/EEA residents. If you are in the European Economic Area, the United Kingdom, or Switzerland, you may have rights under the GDPR or UK GDPR, including access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with your supervisory authority. Our Services are directed to a U.S. audience; if you choose to use them from outside the U.S., you understand that your information will be processed in the United States. See Section 12.

11.5 How to exercise your rights. Submit a request using the contact details in Section 15. We will verify your identity before responding, which may require confirming information associated with your account or email. You may use an authorized agent where permitted by law, subject to verification. We will respond within the time required by applicable law (generally 45 days, extendable where permitted).

12. International Users and Data Transfers

We are based in the United States and process and store information in the United States, which may have data-protection laws different from those in your country. By using the Services, you understand that your information will be transferred to and processed in the United States. Where required, we rely on appropriate safeguards for international transfers.

13. Do Not Track

Some browsers offer a "Do Not Track" (DNT) signal. There is no industry-standard response to DNT, and our Site does not currently respond to DNT signals. We honor recognized opt-out preference signals (such as the Global Privacy Control) where required by applicable law.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date and, if the changes are material, provide additional notice as required by law (for example, by email or a notice on the Site). Your continued use of the Services after the changes take effect constitutes acceptance of the updated Policy.
